1. (a) The application for telepass license shall be denied if:

   1. (1) The applicant fails to meet the requirements set forth in RSA 329-B:16;
   2. (2) The applicant has committed any acts that would be grounds for disciplinary action under RSA 329-B:21, II;
   3. (3) The applicant failed to provide complete documents required for a telepass license; and
   4. (4) The applicant is not of good character as described in Psyc 303.01.

2. (b) Any applicant wishing to challenge the OPLC denial of an application for initial licensure shall:

   1. (1) Make a written request for a hearing of the applicant’s challenge; and

   2. (2) Submit, to the OPLC, the request detailing the applicant’s challenge:

      1. a. Within 60 days of the OPLC’s notification of denial; or
      2. b. If the applicant is on active military duty outside the United States, within 60 days of the applicant’s return to the United States or release from duty, whichever occurs later.
