1. (a) All hearings in any adjudicative proceeding other than a licensing proceeding shall be conducted by the presiding officer designated pursuant to RSA 310:10, IV.
2. (b) All hearings in any licensing proceeding shall be conducted by the presiding officer designated pursuant to RSA 310:11, III.

3. (c) The presiding officer shall have the authority conferred by RSA 310 and RSA 541-A to, as necessary:

   1. (1) Regulate and control the course of a hearing;
   2. (2) Facilitate an informal resolution of the subject matter of the hearing;
   3. (3) Administer oaths and affirmations;
   4. (4) For other than licensing proceedings, issue subpoenas to compel the attendance of witnesses at hearings or the production of documents as provided in RSA 310:10, V;
   5. (5) Receive relevant evidence at hearings and exclude irrelevant, immaterial, or unduly repetitious evidence;
   6. (6) Rule on procedural requests, including adjournments or continuances, at the request of a participant or on the presiding officer’s own motion;
   7. (7) Question any individual who testifies;
   8. (8) Cause a complete record of any hearing, as described in RSA 541-A:31, VI, to be made; and
   9. (9) Take any other action consistent with applicable law necessary to conduct the hearing and complete the record in a fair and timely manner.
