For purposes of this part, the following definitions shall apply:

1. (a) “Respondent” means the person against whom a disciplinary sanction is proposed to be imposed; and

2. (b) “Sexual misconduct” means engaging in one or more of the following activities with respect to a current patient who is not a spouse or domestic partner:

   1. (1) Engaging in sexual relations, whether consensual or non-consensual;
   2. (2) Making verbal or physical sexual advances;
   3. (3) Using sexual language or phrases;
   4. (4) Requesting sexual favors; or
   5. (5) Engaging in physical contact of a sexual nature.
