1. (a) Any person holding a pharmacist license may voluntarily surrender that license by returning it to the board accompanied by a signed letter stating that the pharmacist intends to permanently surrender his or her license.
2. (b) The surrender shall be effective upon acceptance by the board and shall immediately preclude the pharmacist from practicing pharmacy in New Hampshire.
3. (c) A voluntary license surrender, standing alone, shall not prevent the pharmacist from subsequently reapplying for a license.

4. (d) The voluntary surrender of a license shall have no effect upon the board's authority to:

   1. (1) Investigate violations of the pharmacy laws or the rules of the board by a person licensed at the time the alleged violation occurred; or
   2. (2) Impose disciplinary sanctions based on past conduct which could affect the ability of the former licensee to reapply for a license at a later date.
5. (e) A voluntary license surrender during the pendency of a disciplinary proceeding shall be recorded in the board's files as "surrendered during disciplinary proceeding."
6. (f) Nothing in this section shall prohibit the board and a licensee from entering into a settlement agreement or a consent decree relative to any alleged violation of the pharmacy laws or the rules of the board.
