1. (a) If the director disagrees with the request for reclassification, the director shall provide a written or electronic decision to the party requesting the review and to the human resources office of the affected employee.
2. (b) If the director agrees with the request for reclassification, the division shall proceed with processing the change.

3. (c) The effective date of the reclassification shall be:

   1. (1) The first day of the pay period immediately following the decision of the director, if less than 90 days from the filing of a complete request pursuant to Per 303.02;
   2. (2) Retroactive to the first day of the pay period following the 91st day from filing of a complete request pursuant to Per 303.02, if the written decision of the director is issued more than 90 days from the date of a complete request; or
   3. (3) As specified in an applicable collective bargaining agreement.
