1. (a) Before the construction of any new passenger tramway, relocation, or alteration of length of a passenger tramway, the area operator shall submit to the board a profile of the lift line and a plan showing proximity of power lines, structures, woods, highways, and rivers. The plan and profile shall be submitted along with the appropriate application as specified in (c) below, for the type of lift to be constructed, relocated, or altered in length.

2. (b) The operator shall not proceed with construction, relocation, or alteration of length unless:

   1. (1) The operator has received approval from the board; or
   2. (2) The board has not responded within 30 days of receipt of the application.
3. (c) Before any passenger tramway construction, relocation, or alteration of length is started, owners or area operators shall apply for the board’s approval using the application that correlates to the type of lift to be constructed, relocated, or altered in length, as described in Pas 305.04, Pas 305.05, and Pas 305.06.
