Petition Format

(a) The board shall consider any petition which meets the following minimum requirements:
(1) Each petition shall be in legible written format and addressed to the board as follows:

- (2) Petitions for proposed rulemaking shall state the nature of each proposed rule, state the petitioner’s reasons for proposing the rule, and include a text of the proposed rule;
- (3) Petitions for the amendment or repeal of a rule shall identify specifically which rule or rules are to be amended or repealed and state the petitioner’s reasons for proposing the rule change;
- (4) Petitions for a declaratory ruling shall identify all material facts and specify the status, rule or order on which a declaratory ruling is sought;
- (5) Each petition shall include the name and address of the petitioner and, if applicable, the name and address of the organization the petitioner represents; and
- (6) Each petition shall include the date of the petition and be signed by the petitioner.
(b) Notification pursuant to paragraph (a) above shall;
- (1) Be in writing;
- (2) Identify the specific deficiencies; and
- (3) Contain an explanation of how the petition can be corrected and allow the petitioner to amend the petition in accordance with the items of the modification.
- (c) A completed petition which meets the minimum requirements of these rules shall be placed on the next available board agenda.
