(a) Pursuant to RSA 326-D:8, II, misconduct shall be:
- (1) The practice of fraud or deceit in procuring or attempting to procure certification;
- (2) Conviction of any crime demonstrating unfitness to practice midwifery, as further set forth in (b) below;
- (3) Demonstrable gross incompetence of the certificate holder, as evidenced by a violation of Mid 500 resulting in harm to the mother, the fetus, or the newborn;
- (4) Addiction to the use of alcohol or other habit-forming drugs to a degree which renders the certificate holder unfit to practice;
- (5) A legal finding of mental incompetence;
- (6) Willful or repeated violation of RSA 326-D; and
- (7) Suspension or revocation without subsequent reinstatement of certification in another jurisdiction.
- (b) Crimes demonstrating unfitness to practice midwifery shall be crimes involving theft, injury to others, physical, or emotional exploitation of others and violence towards others.
