1. (a) An agent applicant shall:

   1. (1) Submit a business plan of operation detailing how the proposed agency store would operate during the term of the license; and
   2. (2) Submit documentation demonstrating that the applicant meets the requirements of RSA 177:16.
2. (b) The agency store shall be operated as an adjunct to a business that holds a combination license under RSA 178:18.
3. (c) The adjunct business shall have operational financial stability based solely on non-alcohol sales.

4. (d) Other agent applicant selection criteria shall include:

   1. (1) Retail business experience at the current location;
   2. (2) Retail experience at other locations;

   3. (3) Whether the agent applicant, or his or her designated manager, has:

      1. a. A record of felony conviction;
      2. b. Conviction of crime relating to money management fraud;
      3. c. A history of conviction of crimes relating to the abuse of alcohol or controlled substances;
      4. d. A history of violations of the provisions of RSA 179 at the proposed location or at other licensed locations; or
      5. e. Proof that the applicant, if convicted of a felony, meets the requirements of RSA 178:4 for exception;
   4. (4) Financial ability to purchase or lease and equip the agency store at a commission approved location; and
   5. (5) Ability to provide the necessary funds to meet the operating expenses of the agency store.
5. (e) All agency store applicants selected by the commission shall apply for an agency store license as required by Liq 700.
