1. (a) The board, which for this part means the vocation rehabilitation advisory board, shall designate a presiding officer to conduct a hearing on any certified vocational rehabilitation provider (CVRP) or certified vocational rehabilitation provider intern (CVRPI) misconduct complaints filed pursuant to Lab 516.11 when:

   1. (1) The complaint has not been dismissed by the board; or
   2. (2) The complainant disagrees with the board’s dismissal of a complaint filed pursuant to Lab 516.11.
2. (b) The presiding officer shall conduct the proceedings as hearing officer in accordance with the procedural rules set forth at Lab 203 and Lab 204.01 through Lab 204.07.
