1. (a) Prior to performing services in New Hampshire on behalf of a charitable trust, fund raising counsel and the charitable trust for which fund raising counsel intends to perform services shall enter into a contract that complies with RSA 7:28-b, I and II.
2. (b) Prior to performing services in New Hampshire on behalf of a charitable trust, fund raising counsel shall file with the charitable trusts unit Form NHCT-23 “Notice of Fundraising Counsel Contract,” effective September 2022, available at https://www.doj.nh.gov/charitable-trusts/forms.htm.

3. (c) Fund raising counsel shall supply with Form NHCT-23 the following:

   1. (1) The written contract between fund raising counsel and the charitable trust for which fund raising counsel intends to perform services; and
   2. (2) Any amendments to the written contract between fund raising counsel and the charitable trust for which fund raising counsel intends to perform services.
4. (d) Form NHCT-23 shall be signed by a duly authorized representative of fund raising counsel.
