1. (a) The following existing state facilities shall be considered to be qualified, pursuant to RSA 611-A:1, II(c), for the purpose of conducting testing, examination, or analysis of samples collected in a death investigation:

   1. (1) The laboratories of the department of health and human services;
   2. (2) The laboratories of the department of safety;
   3. (3) The laboratories of the department of environmental services;
   4. (4) The laboratories within the university system of New Hampshire; and
   5. (5) Any other public or private in-state facility that is accredited by the relevant generally recognized accrediting body, depending on the type of facility.
2. (b) If no qualified in-state facility is available, samples shall be sent to an out-of-state facility, that is accredited by the relevant generally recognized accrediting body, depending on the type of facility.
