1. (a) “Appearance" means a written notification to the commission that counsel for a party, intervenor or witness intends to actively participate in a public adjudicative hearing.
2. (b) "Complaint" means a written verified statement charging illegal discrimination under RSA 354-A.
3. (c) "Day" means calendar day and includes the next working day if a deadline falls on a Saturday, Sunday or a holiday.
4. (d) “Declaratory ruling" means, pursuant to RSA 541-A:1, V, a ruling by the commission as to the specific applicability of any statutory provision or of any rule or order of the commission.
5. (e) "Determination of probable cause" means a determination made after investigation that there is sufficient evidence upon which a fact finder could form a reasonable belief that the respondent(s) committed one or more unlawful practices.
6. (f) "Director" means the executive director of the New Hampshire commission for human rights.
7. (g) "Filed" means received by the commission at its offices.
8. (h) "Hearing commissioners" means the 3 commissioners designated by the chair of the commission to sit as a panel at a public adjudicative hearing.
9. (i) "Motion" means a request to the presiding officer for an order or ruling directing some act to be done in favor of the proponent of the motion, including a statement of justification or reasons for the request.
10. (j) "Order" means, pursuant to RSA 541-A:1, XI, the whole or part of the commission's final disposition of a matter other than a rule, but not including the commission's decision to initiate, postpone, investigate or process any matter or to issue a complaint or citation.
11. (k) "Parties" means the complainant and one or more respondents.
12. (l) "Presiding officer" means the individual whom the chair of the commission has designated as the chair of the panel of 3 hearing commissioners.
13. (m) "Pro hac vice representation" means representation at the commission in a particular case only by an attorney not licensed to practice in New Hampshire.
14. (n) "Proof by a preponderance of the evidence" means a demonstration by admissible evidence that a fact or legal conclusion is more probably true than not.
15. (o) “Public comment hearing” means a proceeding held pursuant to RSA 541-A:11.

16. (p) "Respondent" means one or more of the following against which a complaint of discrimination has been filed:

    1. (1) A natural person;
    2. (2) A corporation;
    3. (3) An unincorporated association;
    4. (4) An organization;
    5. (5) A partnership;
    6. (6) A limited liability company;
    7. (7) A professional corporation;
    8. (8) A business; and
    9. (9) A unit of state or local government.
17. (q) "Record" means the materials set forth in RSA 541-A:31, VI.
18. (r) “Rulemaking petition” means a petition made pursuant to RSA 541-A:4, I.
19. (s) "Verified" means signed, and sworn or affirmed, before a notary public or justice of the peace.
