Pursuant to RSA 354-A:21-a, I, a superior court trial shall not be available:

1. (a) To any party if a public adjudicative hearing before the commission has begun

   or has been concluded; or

2. (b) To a complainant whose complaint has been dismissed as lacking in probable cause and who has not prevailed on an appeal to superior court.
