All in-state and out-of-state hospital providers shall:

1. (a) Be licensed by the department in accordance with RSA 151, or by the relevant state licensing authority in the state within which the provider operates;
2. (b) Meet medicare participation requirements; and

3. (c) Be a NH enrolled medicaid provider in accordance with the following:

   1. (1) In-state hospitals shall be enrolled as in-state hospital providers; and
   2. (2) Out-of-state hospitals shall be enrolled as out-of-state hospital providers.
