The department shall deny or terminate medical eligibility for HC-CSD if:

1. (a) The MRT, in accordance with He-W 508.09(b), determines that the recipient does not meet the eligibility criteria specified in He-W 508.03 and 508.04; or

2. (b) Both the following occur:

   1. (1) A cost reduction plan is not acceptable in accordance with He-W 508.08(b); and
   2. (2) The recipient fails to submit a request for a fair hearing and for a continuation of benefits during the appeals process to the local district office within 10 calendar days from the date of written notice of adverse decision or termination.
