To be medically eligible for MEAD:

1. (a) An individual who is currently a medicaid recipient shall:

   1. (1) Have been determined eligible for aid to the permanently and totally disabled (APTD) according to RSA 167:6, VI, or aid to the needy blind (ANB) according to RSA 167:6, IV, within the 12 months prior to application for MEAD; and
   2. (2) Not have been terminated from APTD or ANB due to medical improvement during the previous 12 months; or

2. (b) An individual who is not currently an APTD or ANB recipient shall:

   1. (1) Be employed, or self-employed, for pay, pursuant to the provisions of He-W 641.03(b)-(c), on the date of application and during the time eligibility for MEAD is being determined;
   2. (2) Have a medical impairment that meets the Social Security Administration’s Listing of Impairments in accordance with 20 CFR 404, Subpart P, Appendix I; and
   3. (3) Have a medical impairment that has persisted or is expected to persist for a minimum of 48 consecutive months.
