1. (a) For the purpose of determining compliance with RSA 151 and He-P 823, as authorized by RSA 151:6 and RSA 151:6-a, the licensee shall admit and allow any department representative at any time to inspect the following:

   1. (1) The licensed premises;
   2. (2) All programs and services provided by the HHCP; and
   3. (3) Any records required by RSA 151 and He-P 823.

2. (b) The department shall conduct an inspection to determine full compliance with RSA 151 and He-P 823, and other federal or state requirements prior to:

   1. (1) The issuance of an initial license;
   2. (2) A change in ownership, except as allowed by He-P 823.08(f)(1);
   3. (3) A change in the licensing classification; or
   4. (4) The renewal of a license.
3. (c) In addition to (b) above, the department shall conduct an inspection, as necessary, to verify the implementation of any POC accepted or issued by the department.
4. (d) A statement of findings shall be issued when, as a result of an inspection, the department determines that the HHCP is in violation of any of the provisions of He-P 823, RSA 151, or other federal or state requirements.
5. (e) If areas of non-compliance were cited in a statement of findings, the licensee shall submit a POC, in accordance with He-P 823.12(c) , within 21 days of the date on the letter that transmits the inspection report.
