A LTCH, as defined in He-P 802.03(bf), shall be governed by the same regulations as a general hospital with the following additions:
- (a) The hospital shall have an average Medicare inpatient length of stay of greater than 25 days pursuant to Section 114(e) of the Medicare, Medicaid, and SCHIP Extension Act of 2007 (MMSEA) added section 1886(m) of the Act, and codified the provisions of the BBA and BIPA in paragraph (1) of that subsection;
(b) Applicants for a proposed LTCH shall provide a staffing plan that includes licensed professionals who provide services to the LTCH’s patients as:
- (1) Employees;
- (2) Under contract; or
- (3) As members of the LTCH’s organized medical staff; and
- (c) The hospital shall provide sufficient numbers of qualified personnel to meet the needs of patients in the LTCH during all hours of operation.
