1. (a) A psychiatric hospital, as defined in He-P 802.03(ci), shall meet the criteria set forth in He-P 802, including He-P 802.28.

2. (b) Each psychiatric hospital shall have a full time administrator who meets the qualifications for an administrator as defined in He-P 802.17(b) and shall be responsible to the governing body for the daily management and operation of the hospital which, in addition to those responsibilities defined in He-P 802.17(b), shall include ensuring development and implementation of hospital policies and procedures on:

   1. (1) Voluntary and involuntary emergency admission; and
   2. (2) Seclusion and restraints.
3. (c) Psychiatric hospitals shall be exempt from He-P 802.17(e) and (f) and He-P 802.32.
