1. (a) A license shall be valid on the date of issuance and expire the following year on the last day of the month it was issued unless a completed application for renewal has been received.

2. (b) Each licensee shall complete and submit to the department an application form pursuant to He-P 802.05(a)(1) at least 120 days prior to the expiration of the current license to include:

   1. (1) The materials required by He-P 802.05(a)(1) and (5);
   2. (2) The current license number;
   3. (3) A request for renewal of any existing non-permanent waivers previously granted by the department, in accordance with He-P 802.11(f), if applicable. If such a request is not received, the rule(s) for which the waiver was previously requested shall not continue to be waived beyond the expiration of the current license;
   4. (4) A list of any current employees who have a permanent waiver granted in accordance with He-P 802.18(e)(2); and
   5. (5) A copy of any temporary, new, or exceptions or variances or waivers applied for or granted by the state fire marshal, in accordance with RSA 153:5 and Saf-C 6005.
3. (c) In addition to (b) above, if a private water supply is used, documentation that every 3 years the water supply has been tested for bacteria and nitrates and determined to be at acceptable levels, in accordance with Env-Dw 702.02 for bacteria and Env-Dw 704.02 for nitrates.

4. (d) Following an inspection as described in He-P 802.10, a license shall be renewed if the department determines that the licensee:

   1. (1) Submitted an application containing all the items required by (b) and (c) above as applicable, prior to the expiration of the current license; and
   2. (2) Is found to be in compliance with RSA 151, He-P 802, and all federal requirements at the renewal inspections, or has submitted a POC that has been accepted by the department and implemented by the licensee if deficiencies were cited at the renewal inspection.
5. (e) Any licensee who does not submit a complete application for renewal prior to the expiration of an existing license shall not operate.

6. (f) If a licensee fails to submit an application for renewal prior to the expiration of the license and continues to operate:

   1. (1) The licensee shall be considered an initial licensee and shall follow all application requirements set forth for an initial license pursuant to He-P 802.05; and
   2. (2) The licensee shall be subject to a fine in accordance with He-P 802.14(d).
