1. (a) He-P 4038.07 through He-P 4038.22 apply to any person who, under the regulations in He-P 4038, possesses or uses at any site, an aggregated category 1 or category 2 quantity of radioactive material.

2. (b) He-P 4038.23 through He-P 4038.28 applies to any person who, under the regulations of He-P 4038:

   1. (1) Transports or delivers to a carrier for transport in a single shipment, a category 1 or category 2 quantity of radioactive material; or
   2. (2) Imports or exports a category 1 or category 2 quantity of radioactive material; the provisions only apply to the domestic portion of the transport.
