1. (a) To be eligible for community mental health services as a result of having a serious emotional disturbance, a child shall:

   1. (1) Have a serious emotional disturbance;

   2. (2) Have a serious psychosocial impairment as determined through an assessment of the following domains:

      1. a. The child’s:

         1. 1. School or work role performance;
         2. 2. Home role performance;
         3. 3. Community role performance;
         4. 4. Behavior towards others;
         5. 5. Mood and emotions;
         6. 6. Behavior towards self;
         7. 7. Substance use; and
         8. 8. Thinking; and
      2. b. The child’s caregiver’s ability to provide physical and emotional support to the extent necessary to promote the child’s emotional health; and

   3. (3) Have the assessment of psychosocial impairment required by (2) above demonstrate:

      1. a. At least mild impairment in three or more of the child centered domains causing periodic difficulty or distress;
      2. b. At least moderate impairment in one or more child centered domains causing chronic or durable problems; or
      3. c. At least mild impairment in the caregiver’s ability to provide physical and emotional support to the extent necessary to promote the child’s emotional health.
2. (b) Redetermination of eligibility in this category shall occur annually.
3. (c) Redetermination of eligibility in this category shall occur every 2 years.
