1. (a) “Application” means a formal request for assistance pursuant to RSA 126-A:50.
2. (b) “Bureau” means the department’s bureau of homeless and housing services.
3. (c) “Commissioner” means the commissioner of the department of health and human services or his or her designee.
4. (d) “Department” means the New Hampshire department of health and human services.
5. (e) “Emergency shelter” means any facility, the primary purpose of which is to provide temporary shelter, excluding transitional housing, for homeless persons or families.

6. (f) “Homeless” means:

   1. (1) A person or family that lacks a fixed, regular, and adequate nighttime residence; or

   2. (2) A person or family that has a primary nighttime residence that is:

      1. a. A supervised publicly or privately operated shelter designed to provide temporary living accommodations, including:

         1. 1. Hotels and motels;
         2. 2. Emergency shelters; and
         3. 3. Transitional housing;
      2. b. An institution other than a penal facility that provides temporary residence for persons intended to be institutionalized; or
      3. c. A public or private place not designed for, or ordinarily used as, a regular sleeping accommodation for human beings.
7. (g) “Household net income” means the combined income of all members of a household.
8. (h) “Housing security guarantee (HSG)” means a document issued by a provider that pledges the full faith and credit of the department for the payment of the security deposit it guarantees, which is to defray costs associated with damage by a tenant to rented property or non-payment of rent which is not to exceed the equivalent of one month’s rent.
9. (i) “Landlord” means “landlord” as defined in RSA 126-A: 52, III, namely, “a person and such person’s employees, officers, or agents who rent or lease to another person a housing unit used as a dwelling for one or more persons, including single family homes, apartments, mobile homes, prefabricated homes, or other real or personal property used as a dwelling for one or more persons.”
10. (j) “Program administrator” means an employee of the department who oversees the HSG program.
11. (k) “Provider” means a local or area governmental or private nonprofit agency or organization which contracts or enters into agreement with the bureau per RSA 126-A:55 to administer the housing security guarantee program in accordance with He-M 1007 and RSA 126-A:50-59.
12. (l) “Periodic payment” means a fractional amount of the value of the HSG that the tenant pays to the provider until the full amount of the HSG has been paid.
13. (m) “Security deposit” means “security deposit” as defined in RSA 126-A: 52, VIII, namely, “any funds in excess of monthly rent which are required to be transferred from a tenant to a landlord for any purpose.”
14. (n) “Tenant” means a person or family who rents a dwelling or housing unit with the assistance of the HSG program.
15. (o) “Tenant applicant” means a person, family, or an authorized representative who applies for a HSG.
16. (p) “Transitional housing” means residential as well as educational or rehabilitative programs and services for a person or family provided for at least 6 consecutive months.
