1. (a) The resident shall reside and receive services in the NF with reasonable accommodation of individual needs and preferences, including choice of room and roommate, pursuant to 42 CFR 483.10(e), except when the health or safety of the resident or other residents would be endangered.

2. (b) A resident may refuse a transfer to another room within the NF if the purpose of the transfer is one of the following:

   1. (1) To relocate a resident of a skilled NF from the distinct part of the NF that is skilled care to a part of the NF that is not skilled care;
   2. (2) To relocate a resident of a NF from the distinct part of the NF that is not skilled care to a part of the NF that is a skilled NF; or
   3. (3) Solely for the convenience of staff pursuant to 42 CFR 483.10(e)(7) iii.
3. (c) A NF shall provide a resident with written notification before the resident’s room location is changed or before the resident’s roommate is changed.
