1. (a) Adult day services, as defined in He-E 801.02(b) shall be covered for non-acute needs when provided by an adult day program licensed in accordance with RSA 151:2 and He-P 818.

2. (b) Covered adult day services shall include the following services, based on the participant’s needs in the provider care plan:

   1. (1) Supervision;
   2. (2) Personal care services;
   3. (3) Monitoring of the participant’s condition and counseling, as appropriate, on diet, hygiene, or other related matters;
   4. (4) Referrals, as appropriate, to other services and resources that could assist the participant, including any necessary follow-up; and

   5. (5) The following He-P 818 services:

      1. a. Health and safety services;
      2. b. Dietary services;
      3. c. Nursing services;
      4. d. Social services;
      5. e. Rehabilitative services; and
      6. e. Recreational activities.

3. (c) Adult day services shall not be a covered service under this part when:

   1. (1) Provided to a participant receiving residential care facility services; or
   2. (2) Provided to a participant receiving adult family care services.
4. (d) Adult day service providers shall comply with the provider and documentation requirements specified in He-E 803 and He-P 818, in addition to the requirements in He-E 801.33.
