1. (a) Nursing services shall be provided in an individual’s home by a home health care provider licensed in accordance with RSA 151:2 and He-P 809.
2. (b) Nursing services shall be covered when provided by a licensed practical nurse (LPN) or registered nurse working within the scope of services allowed under the Nurse Practice Act, RSA 326-B.

3. (c) The following nursing services shall be covered based on the individual’s need:

   1. (1) Receiving referrals;
   2. (2) Evaluation of the individual’s needs;
   3. (3) Developing a nursing care plan and incorporating this information into the individual’s person-centered plan; and
   4. (4) Providing nursing services in accordance with the individual’s person-centered plan as described in He-E 502.17 and ordered by his or her physician.
4. (d) Contract agencies shall coordinate nursing services to ensure that there is no duplicate provision of services.
5. (e) LPN and registered nursing services shall not be covered when provided for the purpose of nursing oversight of authorized LNA services.
