1. (a) Foster parents who request a waiver of the requirement in He-C 6347 shall submit a written request to the commissioner of the department of health and human services or his or her designee, which includes the following:

   1. (1) The reason for requesting the waiver of the requirement in a specific credential;
   2. (2) The anticipated length of time the requested waiver will be needed;
   3. (3) Assurance that if the waiver is granted the quality of service and care to children, youth, and families will not be affected;
   4. (4) A written plan to achieve compliance with the rule or explaining how the foster parent will satisfy the intent of the rule if the waiver is granted;
   5. (5) The number and ages of children who will be affected by the requested waiver; and
   6. (6) The signature of the person requesting the waiver.
2. (b) A CPSW or JPPO shall request a waiver on behalf of a foster family if a specific credential is needed to adequately provide for the needs and circumstances of a specific child or sibling group.
3. (c) Request for a waiver of any of the provisions of RSA 170-E, or any other rules referred to in this part or of any other state agencies, shall not be permitted.

4. (d) Request for a waiver shall be denied when:

   1. (1) The request does not comply with (a) above;
   2. (2) The department finds that approval of the requested waiver will jeopardize the health or safety of the child(ren) in care;
   3. (3) The department finds that approval of the requested waiver will impair the foster parent’s ability to adequately care for the child(ren) in care; or
   4. (4) The department finds that the written plan described in (a)(4) above does not satisfy the intent of the rule as an alternative to complying with the rule.
