1. (a) Any person may petition for a declaratory ruling by the commission if:

   1. (1) The person is directly affected by RSA 275-C, RSA 362-E or the administrative rules implementing those statutes; and
   2. (2) The legal issues presented by the petition taken together with the facts presented pursuant to Gcd 214.02 (a) (2) and in response to any request of the commission made pursuant to Gcd 214.03 (b) are not substantially the same as those of a matter pending before the commission or a court of law.

2. (b) A petition for a declaratory ruling shall contain:

   1. (1) The name and address of the person making the request;
   2. (2) A statement of the interest of the person making the request;
   3. (3) The text of the ruling being requested;
   4. (4) The reasons for the petition; and

   5. (5) The following declaration signed by the petitioner or the authorized representative of the petitioner:

      "I declare that I have examined the request for a declaratory ruling, including the accompanying documents, and state that, to the best of my knowledge and belief, the facts presented in support of the requested declaratory ruling are true, correct, and complete."
