1. (a) No person shall be issued a permit to release wildlife designated as prohibited in paragraph (b) below.

2. (b) For the purposes of this part, the following species or groups of wildlife shall be designated as prohibited:

   1. (1) The following invertebrates:

      1. a. All indigenous imported into the state; and
      2. b. All exotics;

   2. (2) The following amphibians:

      1. a. All indigenous imported into the state; and
      2. b. All exotics;

   3. (3) The following reptiles:

      1. a. All indigenous imported into the state; and
      2. b. All exotics;

   4. (4) The following fish:

      1. a. All species listed as prohibited for importation or possession pursuant to Fis 803.04 and Fis 803.05;
      2. b. All non-indigenous species; and
      3. c. Any species not naturalized in New Hampshire;

   5. (5) All birds except:

      1. a. Bobwhite quail, northern (Colinus virginianus);
      2. b. Mallard (Anas platyrhynchos) by category 3 or 4;
      3. c. Pheasant, ring-necked (Phasianus colchicus);
      4. d. Partridge, Chukar or redleg (Alectoris chuka); and
      5. e. Partridge, grey or Hungarian (Perdix perdix); and

   6. (6) The following mammals:

      1. a. Exotics; and
      2. b. Extirpated indigenous.
