1. (a) A permit to possess wildlife shall not be required for any person to possess wildlife designated as non-controlled as specified in (b), below.

2. (b) For the purposes of this part, the following species or groups of wildlife shall be designated as non-controlled:

   1. (1) Ornamental aquarium fish, both fresh and marine, that shall be kept in a closed system;
   2. (2) Amphibians, exotic;
   3. (3) Amphibians, indigenous, listed in Table 800.2 for category 1, for up to 5 specimens per species;

   4. (4) Reptiles, exotic, except:

      1. a. Alligator (Alligatoridae, spp);
      2. b. Crocodile (Crocodylidae, spp); and
      3. c. Venomous reptiles, other than the Western Hognose Snake;
   5. (5) Indigenous reptiles listed in Table 800.2 for category 1, for up to 2 specimens of each species;

   6. (6) The following exotic birds:

      1. a. Cockatiel (Nymphicus hollandieus)
      2. b. Canaries (Serinus spp.);
      3. c. Parrots (Psittaciformes);
      4. d. Parakeets (Budgerigar);
      5. e. Mynah Birds (Acridotheres spp);
      6. f. Finches (Estrildidae spp);
      7. g. Pekin robin (Leiothrip lutea);
      8. h. Weavers (Ploceidae);
      9. i. Toucans (Ramphastidae);
      10. j. Button quail (Turnicidae);
      11. k. Pigeons and doves (Columbiformes), exotic;
      12. l. Feral pigeons (Columba domestica and C. livia);
      13. m. Emu (Dromaius novaehollandire);
      14. n. Ostrich (Struthis camelus);
      15. o. Rhea (Rheidae);
      16. p. Waterfowl, exotic migratory except mute swans;
      17. q. Waterfowl, mallard by individuals in category 1; and

      18. r. Gallinaceous birds, except:

          1. 1. Bobwhite quail, Northern (Colinus virginianus);
          2. 2. Grouse, Ruffed (Bonasa umbellus);
          3. 3. Grouse, Spruce (Dendragapus canadensis);
          4. 4. Pheasant, Ring-necked (Phasianus colchicus);
          5. 5. Partridge, Chuckar and Redleg (Alectoris chuka); and
          6. 6. Partridge, Grey/Hungarian (Perdix perdix);

   7. (7) The following mammals:

      1. a. Chinchillas, domesticated, (Chinchilla spp);
      2. b. Gerbils, domesticated;
      3. c. Guinea pigs, domesticated;
      4. d. Hamsters, domesticated (Cricetus cricetus);
      5. e. Mice, domesticated (Mus musculus);
      6. f. Rats, domesticated (Rattus norvegicus and Rattus rattus);
      7. g. Ferrets, domesticated (Mustela putorius furo);
      8. h. Llamas (Lama glama);
      9. i. Alpaca (Lama pacos);
      10. j. Pot belly pigs, domesticated;
      11. k. Rabbits, domesticated;
      12. l. African pigmy hedgehog;
      13. m. Sugar glider (Petaurus breviceps);
      14. n. Tenrec (Tenrec ecaudatus);
      15. o. Yak (Bos grunniens);
      16. p. Camel (Camelus spp.);
      17. q. Asian water buffalo (Bubalus bubalis);
      18. r. Degaus (Octodon degus);
      19. s. Guanaco (Lama quanicoe); and
      20. t. Bison (Bison bison, B. bonasus); and
   8. (8) All marine species originating in the western portion of the North Atlantic Ocean and connected saltwater bays and estuaries, except anadromous and catadromous species.
