1. (a) A permit to import wildlife shall not be required for any person to import wildlife designated as non-controlled as specified in (b) below.

2. (b) For the purposes of this part, the following species or groups of wildlife shall be designated as non-controlled:

   1. (1) Ornamental aquarium fish, both fresh and marine, that shall be kept in a closed system;
   2. (2) Non-indigenous amphibians;
   3. (3) Western Hognose Snake;

   4. (4) Non-venomous reptiles, except the following:

      1. a. Indigenous reptile species listed in Table 800.1;
      2. b. Alligator (Alligatoridae, spp.); and
      3. c. Crocodile (Crocodylidae, spp.);
   5. (5) Non-living indigenous amphibians and reptiles, listed in Table 800.1 for category 1;

   6. (6) The following birds:

      1. a. Cockatiel (Nymphieus hollandicus);
      2. b. Canaries (Serinus spp);
      3. c. Parrots (Psittaciformes);
      4. d. Parakeets (Budgerigar);
      5. e. Mynah birds (Acridotheres spp);
      6. f. Finches (Estrildidae);
      7. g. Pekin robins (Leiothrix lutea);
      8. h. Weavers (Placeidae);
      9. i. Toucans (Ramphastiske);
      10. j. Button quail (Turnicidae);
      11. k. Pigeons and doves (Columbiformes), exotic;
      12. l. Feral pigeons (Columba domestica and C. livia);
      13. m. Emu (Dromaius novaehollandire);
      14. n. Ostrich (Struthio camelus);
      15. o. Rhea (Rheidae);
      16. p. Exotic migratory, except mute swans;
      17. q. Mallard (Anas platyrhynchos); and

      18. r. Gallinaceous birds, except:

          1. 1. Grouse, Ruffed (Bonasa umbellus); and
          2. 2. Grouse, Spruce (Dendragapus canadensis);

   7. (7) The following mammals:

      1. a. Bison (Bison bison; B.bonasus);
      2. b. Wild boar (Sus scrofa);
      3. c. Camel (Camelus spp);
      4. d. Chinchillas, domesticated (Chinchilla spp);
      5. e. Degus (Octodon degus);
      6. f. Deer, fallow (Dama dama);
      7. g. Gerbils, domesticated (Cavia spp);
      8. h. Guanco (Lama quanicoe);
      9. i. Guinea pigs, domesticated (Cavia spp);
      10. j. Hamsters, domesticated (Cricetus cricetus);
      11. k. Mice, domesticated (Mus musculus);
      12. l. Rats, domesticated (Rattus norvegicus and Rattus rattus);
      13. m. Ferrets, domesticated (Mustela putoricus furo);
      14. n. Llamas (Lama glama);
      15. o. Alpacas (Lama pacos);
      16. p. Pot belly pigs, domesticated;
      17. q. Rabbits, domesticated;
      18. r. African pigmy hedgehog;
      19. s. Sugar glider (Petaurus breviceps);
      20. t. Tenrec (Tenrec ecaudatus);
      21. u. Yak (Bos grunniens);
      22. v. Zebra (Equus burchelli, E. grevyi, E. zebra); and
      23. w. Asian water buffalo (Babalus bubalis); and
   8. (8) All marine species originating in the western portion of the North Atlantic Ocean and connected saltwater bays and estuaries, except anadromous and catadromous species.
