- (a) Except as provided in this section, no person shall possess, while on coastal and estuarine waters or when leaving such waters, more marine species than that person may lawfully take in one day.
- (b) Such possession shall be prima facie evidence that those marine species exceeding the applicable single day limit, but less than the 2 day limit set by RSA 207:5, were unlawfully taken by the possessor.
(c) A charter boat or party boat, licensed pursuant to RSA 214:9, XVI(b), may possess up to twice the single day limit of cod or haddock per person on the vessel, if:
- (1) At least 5 working days prior to the commencement of the trip, the owner or operator of the boat notifies in writing the New Hampshire fish and game department’s law enforcement district 6 chief of the owner’s or operator’s intent to possess up to twice the per person single day limit of cod or haddock;
- (2) The boat is on a trip that occurs on more than one day; and
- (3) The boat’s owner or operator presents 2 day’s “Vessel Trip Reports” for the trip, as required under 50 C.F.R. § 648 upon landing, to the executive director or designated agent.
- (d) As used in this section, “day” means a calendar day.
