The department shall not deliver recommendations to the applicant or the referring state agency if:

1. (a) The applicant fails to provide the complete set of information as requested in the notice sent pursuant to Fis 1004.05; or

2. (b) The applicant fails to file a complete response to a request for additional information as specified in the request sent pursuant to Fis 1004.06, unless the partial response:

   1. (1) Explains why the missing information is unavailable or cannot be provided within the specified time; and
   2. (2) Agrees in writing to extend the time to complete the department’s review thereof, and the decision of the referring agency on the underlying permit application, until a reasonable time after the requested information is in fact provided to the department.
