(a) The following shall govern the introduction and admissibility of evidence at hearings:

1. (1) Hearings shall not be bound by the rules of evidence;
2. (2) All relevant and material evidence shall be admissible;

3. (3) Evidence shall include but not be limited to:

   1. a. Depositions;
   2. b. Affidavits;
   3. c. Official documents; and
   4. d. Testimony of witnesses;
4. (4) The presiding officer shall exclude any irrelevant, immaterial, or unduly cumulative or repetitious evidence; and

5. (5) Applicable statutory and constitutional provisions and immunities requiring exclusion of evidence shall be recognized provided however, that nothing contained herein shall prohibit a party from waiving his or her privilege or immunity.
