1. (a) For any major project that proposes to construct a structure in tidal waters/wetlands or to extend an existing structure seaward, the applicant shall submit a statement from the pease development authority division of ports and harbors (“DP&H”) chief harbormaster, or designee, for the subject location relative to the proposed structure’s impact on navigation.
2. (b) If the proposed structure might impede existing public passage along the subject shoreline on foot or by non-motorized watercraft, the applicant shall explain how the impediments have been minimized to the greatest extent practicable.
