1. (a) This part shall apply to dredging projects in non-tidal jurisdictional areas.

2. (b) Where dredging is part of a larger project, it shall also be reviewed under the appropriate project specific section as follows:

   1. (1) Dredging projects for pond construction shall be reviewed under Env-Wt 519;
   2. (2) Dredging for residential, commercial, or industrial development shall be reviewed under Env-Wt 524; and
   3. (3) Dredging associated with restoration/enhancement activities shall be reviewed under Env-Wt 525.

3. (c) This part shall not apply to dredging that:

   1. (1) Meets the criteria for small motor mineral dredging under RSA 482-A:3, XI, and complies with Env-Wt 310.04 through Env-Wt 310.08; or
   2. (2) Is an integral component of a dam project that meets the criteria of Env-Wt 526.
