1. (a) The department shall review an application for a PBN for completeness and compliance with applicable department rules. If the application is complete and complies with applicable requirements, the department shall issue a permit and post it to its website:

   1. (1) Within 10 calendar days of receipt, for those projects identified in Env-Wt 309.07(h) or where a written waiver of intervention from the municipal conservation commission, and from the LAC if required by Env-Wt 309.07(i), has been received; or
   2. (2) Within 25 calendar days of receipt if (1) does not apply.
2. (b) If the PBN application is complete at filing but does not comply with the applicable rule requirements, the department shall deny the application and notify the applicant in writing of the reason(s) for denial within the timelines in (a) above.
3. (c) If the PBN application is not complete, the department shall send a written request for more information to the applicant and the local governing body within the timelines in (a) above identifying any deficiencies and the information necessary to complete the application. The request for more information shall notify the applicant to submit all necessary information within 30 calendar days of the date of the written notice or the PBN application shall be denied.

4. (d) Within 30 calendar days of receipt of a complete response to a request for more information as described in (c), the department shall review the response for compliance with applicable department rules and take one of the following actions:

   1. (1) If the complete application complies with applicable requirements, the department shall issue a permit and post it to its website within 30 calendar days of receiving the complete application; or
   2. (2) If the complete application does not comply with the applicable requirements, the department shall deny the application and notify the applicant in writing of the reason(s) for denial within 30 calendar days of receiving the complete application.
