1. (a) A standard permit as authorized by RSA 482-A:3, I, shall be obtained from the department prior to undertaking any dredging, filling, or construction activity in any jurisdictional area that:

   1. (1) Is not prohibited or exempted by RSA 482-A;
   2. (2) Does not qualify for a statutory permit-by-notification (SPN); and
   3. (3) Is not eligible for an LSA under Env-Wt 306.02 or an EXP under Env-Wt 306.03.
2. (b) An applicant may choose to apply for a standard permit for any project.
