“Existing legal structure” means a structure that has not been abandoned, as defined in Env-Wt 102, and that:

1. (a) Is a grandfathered structure; or
2. (b) Was constructed pursuant to a permit or grant in right issued under RSA 482-A or any predecessor statute and conforms to that permit or grant in right, as applicable.
