1. (a) The department shall approve the removal of the dam if the applicant:

   1. (1) Proposes a dam removal project that meets the criteria of Env-Wr 602.01; and

   2. (2) Demonstrates that the dam removal will be performed in a manner that:

      1. a. Will not cause damage to structures downstream of the dam; and
      2. b. Will not cause environmental damage that cannot self-restore within one year.
2. (b) The department shall notify the applicant and the owner, if the applicant is not the owner, in writing of its decision.
