Exemption from Breach Analysis

- (a) Subject to (c), below, an owner shall be exempted from the development of a breach analysis if the department determines that the hazard classification is based solely on the potential damage to one or more isolated and easily identified bridges, roadways, or other structures located below the dam.
(b) If this exemption applies to a dam, the department shall:
- (1) Notify the owner in writing or by electronic mail of the exemption; and
- (2) Inform the owner of the exact structures to be delineated on a simplified inundation map, as required by Env-Wr 503.02.
- (c) If conditions downstream of the dam change such that additional bridges, roadways, or other structures would be affected by a dam failure and these structures are not isolated and easily identifiable, the department shall notify the owner in writing that the exemption has been repealed and a dam breach analysis, as described in Env-Wr 502.04, shall be required due to the new developments downstream of the dam.
