- (a) An owner may request a time extension to comply with any directive of the department issued pursuant to RSA 482:12.
(b) The request shall be submitted in writing to the department with the following information:
- (1) The reason(s) why an extension is needed;
- (2) The current status of the repairs or investigations; and
- (3) The length of time of extension requested.
(c) The department shall grant the request for time extension if it determines, after review of the information provided in (b), above, that:
- (1) The current condition of the dam is such that it is not expected to fail under flow conditions anticipated during the extension; and
- (2) The condition of the dam will not deteriorate so as to pose a threat to public safety under flow conditions anticipated during the extension.
- (d) The department shall notify the owner of the decision on the request in writing. If the department denies the request, the department shall state the reason(s) for the denial.
