1. (a) An owner may request a time extension to comply with any directive of the department issued pursuant to RSA 482:12.

2. (b) The request shall be submitted in writing to the department with the following information:

   1. (1) The reason(s) why an extension is needed;
   2. (2) The current status of the repairs or investigations; and
   3. (3) The length of time of extension requested.

3. (c) The department shall grant the request for time extension if it determines, after review of the information provided in (b), above, that:

   1. (1) The current condition of the dam is such that it is not expected to fail under flow conditions anticipated during the extension; and
   2. (2) The condition of the dam will not deteriorate so as to pose a threat to public safety under flow conditions anticipated during the extension.
4. (d) The department shall notify the owner of the decision on the request in writing. If the department denies the request, the department shall state the reason(s) for the denial.
