“Non-sludge material” means any substance that:

1. (a) Is not derived from sludge;
2. (b) Is not regulated as a hazardous waste; and

3. (c) Is not regulated as a solid waste or, if a material originally regulated as solid waste or derived from such a material, is no longer regulated as solid waste because it:

   1. (1) Has been certified for use as a waste-derived product under Env-Sw 1500; or
   2. (2) Is wood ash that is either certified under or exempt from Env-Sw 1700.
