Recipients of state or federal funds for projects covered under §211 or 212 of the CWA shall comply with the following bidding requirements:

1. (a) The bid period shall be not less than 30 calendar days;

2. (b) The advertisement for bids shall include the following information as commensurate with the nature and magnitude of the project:

   1. (1) The project name and contract number;
   2. (2) The location of work;
   3. (3) A description of work to be performed;
   4. (4) The names and addresses of persons receiving bids;
   5. (5) The time and date at which the bids will be publicly opened and read aloud, and a statement that bids received after that time will not be accepted;
   6. (6) An address and cost information for obtaining plans and specifications; and
   7. (7) The addresses where plans and specifications can be examined.
3. (c) A bid security in the amount of 5% of the bid shall be required in the form of a certified check or a bid bond executed by a surety company authorized to do business in New Hampshire and made payable to the recipient;
4. (d) A 100% performance bond and a 100% payment bond shall be required;

5. (e) The recipient shall reserve the right to:

   1. (1) Reject any or all bids;
   2. (2) Accept any bid;
   3. (3) Waive any informalities or minor defects on bids received; and
   4. (4) Omit any bid item; and

6. (f) If any addenda to the bid are needed, the recipient shall:

   1. (1) Submit the proposed addenda to the department for review as much in advance of issuing it as possible;
   2. (2) Refrain from issuing the addenda without approval from the department; and
   3. (3) Issue the approved addenda no less than 5 days prior to bid opening.
