The department shall issue or renew, as applicable, a septage hauler permit for the tanks specified in the application if it determines that the following criteria have been met:

1. (a) The applicant has submitted all information and certifications as required by Env-Wq 1605.01;
2. (b) If the application is for renewal of an existing permit or if the applicant engages in other septage management activities in addition to transporting, the applicant is in compliance with all applicable requirements of these rules;
3. (c) All sites, facilities, and septage holding tanks designated for receipt of the septage are permitted to receive, handle, manage, store, use, or otherwise dispose of septage;
4. (d) The applicant has not been convicted of a misdemeanor under any statute implemented by the department within the 5 years prior to the date of application, or of a felony in any state or federal court during the 10 years prior to the date of application;
5. (e) The applicant has paid all fees and administrative fines owed to the department and all civil or criminal penalties owed to the state as a result of a violation of a law administered by the department; and
6. (f) All tanks used to transport septage have been inspected by the department within the previous 2 years and are in compliance with Env-Wq 1605.08.
