1. (a) Whenever a DataCheck request results letter indicates documented occurrences of any protected wildlife species, the applicant shall request an ecological review from the department pursuant to Env-C 800 to assure that the project does not appreciably jeopardize the continued existence of threatened and endangered species as defined Fis 1002.04; and
2. (b) If the department receives evidence of an occurrence of any state- or federally-listed threatened or endangered wildlife species in an area that could be affected by project activities, the department shall refer the project to the ecological review section of the department for a determination as to whether an ecological review pursuant to Env-C 800 is required.
3. (c) If an ecological review is required pursuant to (b), above, the applicant shall request an ecological review pursuant to Env-C 800 to assure that the project does not appreciably jeopardize the continued existence of threatened and endangered species as defined in Fis 1002.04.
