1. (a) For purposes of this section, “business” means a commercial establishment that is open to the public and maintains stocks of aquatic plants for sale or other distribution, including pet stores and nurseries.
2. (b) The department shall inspect, during a business’s normal business hours, the aquatic plants on display to the public.
3. (c) If the department’s inspector observes plants that are on the list of prohibited species, the inspector shall inform the on-site manager of the business of the prohibitions of RSA 487:16-a and request the manager to discontinue the sale or other distribution of the plants.
4. (d) If the department’s inspector observes plants that could be on the list of prohibited species, the inspector shall inform the on-site manager of the business of the prohibitions of RSA 487:16-a and request the manager to provide a sample of the questionable aquatic plant material of sufficient size to allow identification of the plant material at no compensation.
