“Public boat access area” means an area adjacent to a public body of water that:

1. (a) Is owned or controlled by the state, is available for public use, and has been designated by the fish and game department as a boat launching area under the statewide public boat access program; or
2. (b) Has otherwise been formally designated by the appropriate authority as available for public use, without any residency requirement.
