The applicant shall provide a copy of each executed easement to the department prior to construction approval and shall depict the approximate location of the easement(s) on the site plan if:

1. (a) An ISDS is located on property other than that on which any buildings served by the ISDS are or will be located, unless the properties are owned by the same person or entity; and
2. (b) An easement on property other than the property where the ISDS will be located is required, including but not limited to a nitrate setback easement or lot loading easement.
